Former DelCo deputy pleads not guilty to misconduct

FRANKLIN - A former Delaware County Sheriff’s Deputy, Tyler J. McAteer, 32, Franklin, pleaded not guilty to one count of official misconduct in Franklin Town Court, Thursday, June 27.

McAteer is accused of using a video of two underage individuals engaged in sexual intercourse as well as still nude photographs of an underage individual, recorded on his department-issued phone, for his sexual gratification while off duty.

McAteer was arrested by Sidney State Police March 6.

Charging documents allege that between Dec. 14, 2022 and early 2023, McAteer recorded a video of two children engaged in sexual intercourse, while acting in his official capacity. McAteer is further accused of “unlawfully viewing” the photographs and video on the county-issued cellphone “with the intent to obtain the benefit of sexual gratification while in an off-duty capacity.”

Following McAteer’s arrest, he was placed on paid administrative leave pending a formal investigation. According to Delaware County Sheriff Craig DuMond, McAteer is no longer an employee of the department.

The charge is a misdemeanor, punishable by one year in jail.

Special Prosecutor John Muehl, Otsego County District Attorney consented to McAteer’s release without bail, as the charge is a non-bailable offense.

The case has been rescheduled for a further appearance on July 25.
